2. When asked if you have been drinking, DO NOT ANSWER THE QUESTION. Instead, tell the officer, "I AM EXERCISING MY RIGHT TO REMAIN SILENT." Please note: You must say the magic words! (In order to properly exercise the right to remain silent, you have to speak up.)

 
The officer already knows you have been drinking. If you say no, you are lying. If you say yes, you are incriminating yourself. This is a catch-22. Don't fall for it. SAY THE MAGIC WORDS.
