OPINION
ORDER
On the Court's own motion, the May 18, 2004 opinion is hereby VACATED. The opinion contained the following omission: The Michigan Supreme Court's December 10, 2002 order, remanding this case for consideration as on leave granted, directed this Court to address whether MCL 257.625(8)(c) "mandates a minimum sentence for an individual sentenced to the Department of Corrections" within the meaning of MCL 769.34(2)(a), as well as the applicability of MCL 769.34(4)(a) under these circumstances. Our initial opinion did not address the applicability of MCL 769.34(4)(a). A new opinion is attached which addresses the applicability of MCL 769.34(4)(a), as directed by our Supreme Court.
