State of Michigan v Auri, Docket No. 287838, unpublished October 29, 2009 (2009) Michigan Court of Appeals 2009 Motion to quash was improperly granted. Evidence that defendant was involved in a traffic accident nearby inferentially supported the elements of Operaring While Under the Influence of Controlled Substance Causing Death. See People v Terry, 224 Mich App 447, 451; 569 NW2d 641 (1997). That is all that is necessary to deny the motion to quash.
State of Michigan v Bain, Docket No. 268527, Unpublished June 21, 2007 (2007) Michigan Court of Appeals 2007 Relying essentially on Ohio law, the Michigan Court of Appeals held that the Datamaster was accurate and reliable, satisfying Daubert because lawmakers had adopted it. But lawmakers never adopted the Datamaster, ever. In fact, the Datamaster was never even properly adopted in Michigan through the Administrative Procedures Act.
