Unless the defendant had more than two prior convictions for drunk driving or a horrible felony record, 2 to 5 years for a felony drunk driving charge is excessive. The Michigan Sentencing Guidelines would not impose a prison sentence for a typical OWI 3rd.
There are currently 105 district courts in Michigan and 276 district court judges. The 36th District Court is by far the largest and busiest. According to these reports, however, the 36th District Court in Detroit, Michigan may lose one of its judges.
Here's a strange one... Up in Canada, drunk driving laws that suspend a motorist's driving privileges have been declared unlawful. (I am unclear on the reason why the current Canadian laws were stricken by the courts, but lawmakers have been forced to reevaluate their current laws.) The police and local lawmakers have responded by moving to decriminalize drunk driving. This is just incredible. Even more incredible? MADD and defense attorneys agree that this move is wrong!
So... if the DRE makes the traffic stop, they can administer the oral fluids test, but if they are called to assist in a drugged driving arrest by another officer, they cannot administer the oral fluids test?
Wow. Just wow... Police officers in Canada will be able to suspend your driver's license and fine you without a trial and without any criminal charges ever having been filed. This is just crazy!
The Daily Beast reports that a United States Military Academy West Point football player, Brandon Jackson, violated the Honor Code by drinking alcohol after a football game because he was underage. Jackson was later involved in a fatal motor vehicle accident with a .12 blood alcohol level.
